Judge Marchena's trick letter to the CJEU (14 OCT 2019)

This is an English translation of a letter in which Judge Marchena (Supreme Court) sends a copy of the Judgment to the CJUE, handed down BEFORE the preliminary ruling he had requested on Oriol Junqueras' status as an MEP, and tricking it by saying that the ruling will nevertheless be valid and efficient.

Your Excellency:

I enclose a copy of the judgment issued today in Special Cause 20907/2017,  which is referred to in the Request for a preliminary ruling No. C-502/19. I inform you that the aforementioned request continues to maintain its interest and validity for this Supreme Court, since the response of the Court of Justice will be effective, regardless of the situation of preventive or penalized prison affecting D. Oriol Junqueras i Vies.

Adjunto remito copia de la sentencia dictada en el día de hoy en la Causa Especial 20907/2017, a la que se refiere la cuestión prejudicial C-502/19. Pongo en su conocimiento que la citada cuestión prejudicial sigue mantentiendo su interés y vigencia para este Tribunal Supremo, toda vez que la respuesta del Tribunal de Justicia tendrá eficacia con independencia de la situación de prislón preventiva o penado que afecte a D. Oriol Junqueras i Vies.
