The prosecution indictments of the Spanish public prosecutor's office and the State Legal Office against the political leaders of the independence movement once again stirred up public opinion yesterday, and not only on the pro-independence side. This level of outrage will surely not be felt again until the verdicts, in a few months' time. "I got angrier by the page," says lawyer Gonzalo Boye on the phone, after reading the texts. They are the confirmation of what he had already ventured months ago, but he is angry all the same. The lawyer coordinating the defence of the politicians in exile believes that, in the trial, the lawyers 'will have to pull all the stops out' and focus on showing that Spain has violated the political prisoners' rights. Why? Because he is sure that the sentences will be very tough and so they need to think about Strasbourg from the start.

"Did you honestly expect such harsh charges?"

"Yes. In fact, at the beginning of August, I told the prisoners that there would be 25 years' prison sentences. I think it is more logical to tell the people what they have to be prepared for and what tbey have to face up to."

"How can defence counsels prepare their request for acquittal in a trial where they face charges of 25 years in prison?"

"There can be two strategies: to defend the defendants and to argue that what the defendants have done is not a crime."

"And you would opt for the second one."

"Yes. The fundamental question is not if there was more or less violence, if this guy or that was the boss, but to defend that calling a referendum and going out into the street to demonstrate and to try to attain independence are not crimes. It is a democratic exercise, the right of association, the right of demonstration and the right of freedom of expression. This has to be defended. If not, you slip into their narrative. The strategies are compatible, but they have to be developed. It is not the same to go to Strasbourg proposing deliberations on fundamental rights such as the right of defence or the right of the presumption of innocence, than to go to Strasbourg and say that these guarantees have been violated because prior to that civil rights, that also are fundamental, have been violated, such as the right of demonstration, of association and of not being a victim of the arbitrariness of the State. All these rights are much more attractive in Strasbourg than the violation of procedural rights."

"You are already speaking of appealing the sentences before the European Court of Human Rights. Do you envisage very tough convictions?"

"Well of course! I expect a very harsh verdict. And we have to pull out all the stops at the trial. We mustn't go there with misgivings."

"Legally, what does "pulling out all the stops" mean?"

"That every full stop and every comma, not only of the indictment charges, but of all that is to come, has to be challenged. A tough battle has to be waged, so that fundamental things, such as the fact that these deeds outside of Spain are not crimes, get accreditted."

"Is a joint defence fundamental?"

"I think that a coordinated defence has to be prepared, rather than a joint one. Let each counsel address part of the procedure, part of the legal issues and part of the debate. Other than the case of Santi Vila, all the defences are perfectly compatible. But one thing is for them to be compatible and another is for them to be uniform, because if they are uniform, you get a uniform reply."

"What sort of trial do you expect, bearing in mind who the judges will be?"

"They are judges that have not tried for many years. The Supreme Court is not a court of law, but of appeal. So it will have to speed up the trial a lot, and obviously, they will assail the defence lawyers. No, it will not be an easy trial."

"Do you think these judges might take on board even Vox's requests for the penalties that they may make in the conclusions of the trial? Or is that unthinkable?"

"We would have to ask senyor Joaquim Forn that. I say this ironically. But judge Llarena drew on Vox's request so as not to let him free. Senyor Forn is behind bars solely because Vox asked for it. In this trial, I would expect anything, and nothing good."

"Why you think the State's lawyers have accused them of sedition, if they became a party to the case on the grounds of misuse of public funds?"

"The State's lawyers have had a variable posture. They became a party on grounds of misuse of public funds, on August 8 they asked for the trial to be opened on charges of rebellion, misuse of public funds and contempt of court, and now they have charged them with sedition and misuse of public funds. For me, to go for the sedition issue is a procedural and especially legal stupidity, because the crime of sedition, by definition, is hardly democratic. But the terms in which it is described in the criminal code are very ambiguous, everything fits into it. That is to say, in Spain something called the free assessment of the evidence governs. I exhibit a piece of evidence and say that it is white, and the judge says it is grey. It is his/her free assessment, it isn't invented. He or she says it's grey. And so, as the piece of evidence is grey, they charge you with sedition. In the case of rebellion, the criminal code has some requirements that cannot perhaps be fulfilled with the free assessment of the evidence. So sedition is the trap-crime. And besides, it bears with it very high penalties. Up to fifteen years. Of course, when one is facing 25 years, fifteen seems a gift, but fifteen's fifteen, eh? A decade and a half!"

"Speaking of evidence, in the public prosecutor and the State lawyers' indictments, no misuse of public funds is shown. Is it normal for this to happen? That is to say, to push charges for crimes that cannot be shown?"

"It is not that the misuse of public funds is not backed up with evidence, it is the very State lawyers' indictment that says that the quantity misused is still unclear. But heck: if the quantity misused is not clear, what the hell are they talking about? It's as if they told you that it isn't clear whether a particular person has killed someone, but as that person isn't around, it means they are dead, so I charge you with murder."

"But without a body there is no crime."

"Yes, but as it isn't clear, we will put them on trial in any case. This is what they are doing."

"If there is no evidence, the offence of misuse of public finds will drop during the trial."

"It is an offence that may drop, we shall see. The indictment is already there, so the criterion of the Court will play an important role. In Spain, and in other legal frameworks, there exists the concept of ‘clues'. That is to say, I have no evidence of the deed, but from this clue and from that one, I deduce that the deed has taken place."

"How do you analyse the end of the investigation and the indictment text written by the Spanish government's authorities - the public prosecutor and the State's lawyers - since the PSOE reached the Government?"

"I would detach one thing from the other. At this moment in time, the Supreme Court public prosecution is not controlled by the government; what's more, they are not even controlled by the prosecutor-general. They do their own thing, this text is written in civil war mode."

"Beyond the prisoners' situation, what is at stake in this trial?"

"In this trial the freedom of expression, the freedom of assembly, the freedom of demonstration and the right of self-determination, not only of the Catalans, but of the Spanish, will be at stake. For here1 a precedent will be established that will be thrust in our face when we meet at the next corner. The message in this trial is very clear: the Head of State and the indissoluble unity of the Spanish nation are unbroachable."

"To conclude, are you prepared for new EAWs*?"

"Yes, we have always said so. And we are ready for them. Let them come whenever they like."

In my parents' house there was an old copy of a book that all my brothers had read: "About when beasts spoke", by Manuel Folch i Torres. My father was inflexible and, just as Thackeray's The Rose and the Ring and Josep Maria Folch i Torres' Bolavà, held that one could not grow up without having read them. It was a delightful book in which owls, bears, elephants, deer and bumblebees spoke, a collection of fables for children's education. Now when you look at your country you see beasts talking again. But they are of another type. Snakes, vipers, hyenas. Beasts, though, in human form, that those up hatred. A hatred - outraged, nauseated, like copper-green -, against everything that the Catalan language stands for. They are here, amongst us. They repudiate any expression of Catalan-ness. It's a sickly phobia. There is something Freudian about these beasts. Or a small glitch in their DNA chain. Poor individuals! They live in a country of which they know nothing: its culture, its traditions, its history. They deaf and blind to anything that smells Catalan to them. It brings them out in spots. They spurn everything that is not Spanish and in Spanish. They have names and surnames, these beasts do. We all know one. These beasts abound. They live, die and multiply. One of them was responsible the other day for an incident that has not reached Catalonia and deserves to be explained, as an outstanding example of the bestiality of these beings. Poor beasts, it's all they're capable of. One of the few airlines that accepts Catalan with normality is Swiss. If you have taken any of their flights to the ancient Confederation, you will have found how they use our language when it comes to taking off or landing the craft. This is an exception, for unfortunately, the rest of the companies still treat us exactly as what we are, the last colony in Europe. Well, a couple of weeks ago one of these beasts travelled on a Swiss flight. On arriving at the destination, the usual observations prior to the landing were announced in Catalan. The beast, automatically, secreted his angry spittle. The stench of a sewer left his seat. He moved, restless, desperate, horrified at having to hear four words in Catalan. He had no escape. A mucous sweat, like a toad with a cold, dripped down from his armpits. You have to imagine the beast, after such a long time - they can live in their Spanish world without any problems -, listening to four words in a language they hate. Outraged, he decided to write a letter to a German newspaper in Zurich, complaining about the treatment he had received because "his rights were violated" as Spanish was the "first" official language of Spain. And the complaint of the beast was published, splashed across the page. Thank goodness, our good friends of the Casal Català of Zurich  responded and left clear things (so many embassies and Sea Consulates and look, a small Catalan club is the one who has mobilized thanks to the decency and dignity of his members). But why do we have to mobilize each time? When will the beasts' attacks end? How can we endure, in 2008, so much anguish, so much humiliation and contempt?

A casa els pares corria un vell exemplar d’un llibre que tots els germans havíem llegit: De quan les bèsties parlaven, d’en Manuel Folch i Torres. Però són d’un altre tipus. Carronyaires, escurçons, hienes. Bèsties amb forma humana, tanmateix, que glopegen odi. Un odi pertorbat, nauseabund, com de dentadura postissa amb verdet, contra tot el que representa la llengua. Són aquí, entre nosaltres. Els repugna qualsevol expressió de catalanitat. És una fòbia malaltissa. Hi ha alguna cosa freudiana en aquestes bèsties. O un petit sotrac en la seva cadena d’ADN. Pobres individus! Viuen en un país del que ho desconeixen tot: la seva cultura, les seves tradicions, la seva història. Es passegen impermeables a qualsevol esdeveniment que representi el fet català. Els crea urticària. Els rebota tot el que no sigui espanyol i en castellà. Tenen nom i cognoms, les bèsties. Tots en coneixem alguna. Abunden, les bèsties. Viuen, moren i es multipliquen. Una d’elles va protagonitzar l’altre dia un incident que no ha arribat a Catalunya i mereix ser explicat, com un exemple extraordinari de la bestialitat d’aquests éssers. Pobres bèsties, no poden fer-hi més. Una de les escasses companyies aèries que vénen acceptant amb normalitat el català és Swiss. Si han agafat algun dels seus vols a la vella Confederació, hauran constatat com es ve emprant la nostra llengua a l’hora d’enlairar-se o aterrar l’aparell. Una excepció, ja que, malauradament, amb la resta de companyies venim essent tractats exactament com el que som, la darrera colònia en terres d’Europa. Doncs bé, fa un parell de setmanes viatjava en un vol de Swiss una d’aquestes bèsties. En arribar al destí, s’anuncià en català les típiques observacions prèvies a l’aterratge. La bèstia, automàticament, segregà la seva salivera rabiosa. Una fortor de cloaca sortia del seu seient. Es removia, inquieta, desesperada, horroritzada per haver de sentir quatre mots en català. No tenia escapatòria. Una suor mucosa, com de gripau refredat, li rajava de les aixelles. Cal imaginar-se-la, a la bèstia, després de tant temps!, elles que poden viure en el seu món espanyol sense cap problema, escoltant quatre mots en una llengua que odia. Indignada, va decidir escriure una carta en un diari alemany de Zuric, queixant-se del tracte rebut ja que "es violaven els seus drets" al ser el castellà la "primera" llengua oficial d'Espanya”. I, a tota plana, la queixa de la bèstia va sortir publicada. Gràcies a Déu, els bons amics del Casal Català de Zuric han replicat i han deixat les coses clares (tantes ambaixades i consultats de Mar i, mira tu, un petit Casal Català és qui s’ha mobilitzat gràcies a la decència i dignitat dels seus membres). Però per què ens hem de mobilitzar cada vegada? Quan acabaran els atacs de les bèsties? Com podem el 2008 aguantar tanta vexació, tanta humiliació i tant menyspreu?

There was widespread criticism of the patriotic tone (which was taken to refer to his stance on the Catalan process) in a letter sent by Spain's top judge to a colleague on his deathbed. Statement in relation to the charges laid by public prosecutor's and the State legal office.

The Catalan Association for Civil Rights wants to make it clear that we are faced with a flagrant violation of rights and freedoms that are not appropriate in a democratic state such as the one that Spain claims to be.

Today, the State public prosecutor and the State Legal office have once again shown that, within what they want to pose as a purely legal matter, there is a clear search for revenge and ideological persecution against politicians and activists who only put into practice the unconditional exercise of their fundamental rights. We therefore believe that the positioning of the public prosecution and the State legal office is not only unfair but also based on a false and unfounded premise. The only position that would fit the facts would be for all charges against the defendants be dropped, as they have not committed any crime.

These indictments seek to criminalize the full exercise of democratic rights such as the right to self-determination, the right of peaceful assembly and the right of political dissidence. A State ought to ensure such rights as the only way to resolve political conflicts.

Far from being discouraged, the Catalan Association for Civil Rights, as a joint platform for the victims of tne reprisals and their relatives on charges of rebellion, we remain firm and persistent in denouncing the judicialization of politics, the flagrant violation of rights and freedoms, and the arbitrary use by Spain of its power in the courts.

For all these reasons, we call for the response to this and future scenarios to be always unquenchably peaceful and to be coordinated by the main institutions, parties, organizations and political agents who may feel the duty to defend democracy, freedom and fundamental rigjts.

Comunicat en relació a I'acusació de fiscalia I de I'advocacia general de I'Estat.

Des de I'Associació Catalana pels Drets Civils volem tomar a fer evident que estem davant d'una flagrant vulneració de drets i llibertats impròpies d'un estat democràtic com el que pretén ser I'Estat Espanyol.

Avui la fiscalia General de I'Estat i I'Advocacia general de I'estat han tornat a demostrar que dins del que volen fer passar com un assumpte netament legal hi ha una clara recerca de venjança i persecució ideològica cap a politics i activistes que només van dur a la pràctica I'exercici incondicional dels seus drets fonamentals. Per tant entenem que el posicionament del ministeri fiscal i I'advocacia general de I'estat, no només és injust sinó que també es basa en un retat fals i infundat. L'única posició que s'ajusta a la realitat és que es retirin els càrrecs a tots els acusats i acusades, ja que no han comès cap delicte.

Aquests escrits d'acusació pretenen criminalitzar el ple exercici de drets democràtics com són el dret a I'autodeterminació, de manifestació pacífica I dissidència política. Drets que un Estat hauria de garantir com a única via per resoldre conflictes politics.

LIuny de defallir, I'Associació Catalana pels Drets Civils, com a plataforma conjunta dels represaliats I els seus familiars per la causa de rebel·lió, ens mantenim ferms i persistents en la denúncia de la judicialització de la politica, la vulneració flagrant de drets i llibertats, i I'ús arbitrari que I'Estat Espanyol fa del seu poder judicial.

Per tot això, demanem que la resposta a aquest fet i als que vindran sigui sempre insubornablement pacífica i coordinada per part d'institucions, partits, entitats i agents politics rellevants que se sentin amb el deure de defensar la democràcia, la llibertat i els drets fonamentals.

... el Grupo de Trabajo emite la siguiente opinión:
  • La privación de libertad de Jordi Cuixart, Jordi Sánchez y Oriol Junqueras es arbitraria, por cuanto contraviene los artículos 2, 9 a 11, y 18 a 21 de la Declaración Universal de Derechos Humanos y los artículos 3, 14, 19, 21, 22 y 25 del Pacto, y se inscribe en las categorías II, III y V.
  • El Grupo de Trabajo pide al Gobierno que adopte las medidas necesarias para remediar la situación de los Sres. Cuixart, Sánchez y Junqueras sin dilación y ponerla en conformidad con las normas internacionales pertinentes, incluidas las dispuestas en la Declaración Universal de Derechos Humanos y el Pacto.
  • El Grupo de Trabajo considera que, teniendo en cuenta todas las circunstancias del caso, el remedio adecuado sería poner a los Sres. Cuixart, Sánchez y Junqueras inmediatamente en libertad y concederles el derecho efectivo a obtener una indemnización y otros tipos de reparación, de conformidad con el derecho internacional.

"El delito de rebelión, por razones obvias, se ha convertido en una cuestión central, jurídica y políticamente, de la actual coyuntura del  procés. Mi opinión al respecto se resume en dos consideraciones. Primera: no creo que se pueda acusar de haber cometido ese delito (artículo 472 del Código Penal) a los líderes independentistas procesados. "...Nuevamente, las inopinadas declaraciones del Ministro de Justicia en relación a la investigación que se sigue en el Tribunal Supremo, el denominado “procés”, son poco respetuosas con la separación de poderes y la independencia judicial. El Sr. Català pronostica con total seguridad el futuro procesal de los investigados y anticipa sin ningún rubor las fechas y el contenido de las resoluciones judiciales, hasta el punto de afirmar que la sentencia se dictaría antes del mes de diciembre del presente año.
Junto a estas manifestaciones desafortunadas, informaciones publicadas en un periódico de ámbito nacional y no desmentidas dan cuenta de los contactos de miembros del Gobierno, empezando por su Presidente, a magistrados del Tribunal Constitucional previos a la deliberación sobre la admisión a trámite del recurso interpuesto por el propio Gobierno contra la resolución del Presidente del Parlamento de Cataluña. Debemos de recordar que el Tribunal Constitucional es el intérprete supremo de la Constitución y que sus magistrados son independientes e inamovibles en el ejercicio de su mandato, de forma idéntica a los miembros del Poder Judicial. Es por ello, que tales contactos son inadmisibles en un Estado de Derecho y no tienen otro objetivo que tratar de influir en el sentido de la resolución a dictar por el Alto Tribunal.
Estas injerencias, no conviene olvidarlo, socavan la confianza de los ciudadanía en los Tribunales de Justicia así como en el Tribunal Constitucional y lastran la credibilidad de actividad diaria de magistrados y magistradas en el ejercicio de su función..."

Adolfo Prego, en 2008 magistrado del Supremo y vocal del Consejo General del Poder Judicial (CGPJ), advirtió al Partido Popular (PP) del peligro que suponía  para la unidad de España la supresión del Código Penal de 1995 del artículo 214, que había venido figurando desde el siglo XIX, y que castigaba con penas de prisión de 6 a 12 años la proclamación de la independencia de un territorio de España sin necesidad de que hubiera violencia, tipificándolo como un delito de sedición impropia.
