Catalonia is a country where Parliament approves the levying of a tax on banks for big fortunes and the Constitutional Court overrules it.

Catalonia is a country whose Parliament decides by law to protect citizens who have been swindled for mortgages or "preferential" investments and the Constitutional Court overrules it.

Catalonia is a country where Parliament legislates to ensure poor families have light, water and gas during the winter months and the Constitutional Court overrules it.

Catalonia is a country where Parliament legislates to levy a tax for each empty dwelling and devote it to social rent and the Constitutional Court overrules it.

Catalonia is a country where Parliament adopts gender equality policies and the Constitutional Court overrules it.

Catalonia is a country where Parliament decides that Catalan is the language of instruction in schools and the Constitutional Court overrules it.

Catalonia is a country where Parliament decides to levy a tax on nuclear power stations and to allocate the proceeds to environmental protection and the Constitutional Court overrules it.

This summary is read in two minutes, but the list, which could be three times as long, has been growing as the years go by.

University student grants, railway infrastructure, car licence plates, opening hours, and a hundred other competencies are missing from it, which have made it abundantly clear that, no matter how large the majority in Parliament, when the chips are done all these laws are so much smoke, because Madrid always has the last word.

After 38 years of a Constitution and the start of the so-called devolution, the legal legacy makes clear to us the modus operandi: the competency is transferred to the Autonomous Community, it is exercised, but if the law is not to the liking of the State authorities, two things can happen: either the Constitutional Court overrules it or it adopts a Spanish law that, as the Constitution says, ranks above the regional one that, in practice, is repealed.

And when you ask yourself if it is worthwhile to continue with a state like this, it turns out that asking this is also banned.  As is also banned - and at risk of imprisonment - allowing a debate in Parliament about a state that did not ban so much would look like.

This is also banned.

And so, as a ban on banning, there are more and more people who, instead of asking the forbidden question, have started , already have the answer.  No one has asked them because it is prohibited.


 And when after a forbidden question do you have a convincing answer?  Then no longer there is a court that tosses it.

Catalunya és un país on el seu Parlament aprova garantir que les famílies pobres tinguin llum, aigua i gas els mesos d’hivern i el Tribunal Constitucional ho tomba. 

Catalunya és un país on el seu Parlament aprova cobrar un impost per cada pis buit i dedicar-lo a lloguer social i el Tribunal Constitucional ho tomba. 

Catalunya és un país on el seu Parlament aprova fer polítiques d’igualtat entre homes i dones i el Tribunal Constitucional ho tomba. 

Catalunya és un país on el seu Parlament aprova que el català és la llengua vehicular a l'escola i el Tribunal Constitucional ho tomba. 

Catalunya és un país on el seu Parlament aprova cobrar un impost a les centrals nuclears i destinar-ne l’import a la protecció ambiental i el Tribunal Constitucional ho tomba.

Catalunya és un país on el seu Parlament aprova cobrar una taxa a les operadores d’Internet per dedicar-lo a la cultura i el Tribunal Constitucional ho tomba. 

Catalunya és un país on el seu Parlament aprova prohibir les corrides de toros i el Tribunal Constitucional ho tomba.

Aquest resum es llegeix en dos minuts, però la llista –que podria ser el triple de llarga- s’ha anat gestant amb anys. 

Hi falten les beques universitàries, les infraestructures ferroviàries, les matrícules als cotxes, els horaris comercials, i un centenar de competències més en les que se li ha deixat clar que, per més majories que hi hagi al Parlament, a l’hora de la veritat quedaran en paper mullat perquè la última paraula la té sempre Madrid. 

Després de 38 anys de Constitució i d’inici de la presumpta descentralització el llegat jurídic ens deixa ben clar el modus operandi: es traspassa la competència a la Comunitat Autònoma, s'exerceix, però si la llei no agrada a l’administració estatal, una de dos: o el Tribunal Constitucional la tomba o es redacta una llei espanyola que, tal com diu la Constitució, té un rang superior a l’autonòmica que, a la pràctica, queda anul•lada.

I quan et preguntes si val la pena continuar amb un estat així, resulta que preguntar-t’ho també està prohibit. Com també està prohibit –i amb risc de presó- permetre fer un debat al Parlament sobre com podria ser un estat que no prohibís tant. 

Això també està prohibit. 

I així, de prohibició en prohibició, cada vegada hi ha més persones que enlloc de fer-se la pregunta prohibida comencen a tenir ja la resposta. Sense que ningú els ho hagi preguntat perquè està prohibit. 

I quan després d’una pregunta prohibida tens una resposta convençuda? Llavors ja no hi ha tribunal que ho tombi.
