Given that diagnosis and confinement are
vital needs in the eradication of the pandemic, and considering the current
situation in the country; and in view of Order INT/227/2020, of March
15, in relation to the measures adopted in the scope of Prison Institutions under Royal Decree 463/2020, of March 14,
and being aware of the existence of a Circular from the
Director General de Ejecución Penal y Reinserción
Social de Instituciones Penitenciarias dated
March 18, 2020 in which it is ordered that inmates classified in the
third degree or to whom the flexibility regime is being applied can
stay in their homes without having to sleep in the penitentiary
centres, precisely in order to apply the measures that guarantee the
eradication of the disease, we the undersigned WARN
About the need that the Prison Treatment Boards, and considering that the inmate population is "especially vulnerable" in the face of Covid19 contagion because they live in closed spaces, and since they cannot leave and cannot have sufficient means of health protection, and especially so as a result of the current state of alarm, and these places being a suitable places for propagation without control of contagion among prisoners, we REQUIRE
That the competent body, in this case the Treatment Boards, begin without delay the application of this measure and proceed to
release the prisoners who are already in the re-socialization
situation pursuant to article 25.2 of the Constitution and have the category of
the third degree or second degree with limited parole
measures.
We reiterate that the limited parole regime granted to them ensures the protection of these spaces and of the population that is in detention, and mass contagion can thus be avoided in an already vulnerable population.

a la necessitat de que el diagnòstic i el confinament són vitals
per eradicar l'estat de pandèmia, i considerant la situació actual
del país, i vista la Ordre INT/227/2020, de 15 de març, en relació
amb les mesures que s'adopten dins l'àmbit de les Institucions
Penitenciàries a l'empara del Real Decret 463/2020, de 14 de març,
i tenint coneixement de l'existència d'una Circular del Director
General de Ejecución Penal y Reinserción Social de Instituciones Penitenciarias de data 18 de març de 2020
on s'ordena que als interns classificats en tercer grau o als que
tinguin aplicat el règim de flexibilitat puguin romandre a les seves
cases sense necessitat de tornar a dormir als centres penitenciaris,
justament a fi d'aplicar les mesures que garanteixin l'eradicació de
la malaltia, els sotasignats ALERTEM
De la necessitat que des de les Juntes de Tractament de les presons, i atenent a que la població reclusa és "especialment vulnerable" en front del contagi per Covid19 pel fet que conviuen en espais tancats, i donat que les mateixes no poden sortir i no disposen de mitjans de Protecció de salut suficients i més derivats de l'estat d'alarma actual, i sent lloc idoni de propagació sense control de contagi entre els reclusos, i REQUERIM
De
l’òrgan competent, en aquest cas les Juntes de Tractament, perquè
iniciïn sense dilacions l'aplicació d'aquesta mesura i procedeixin
a l'excarceració d'aquelles persones preses que es troben ja en una
situació de socialització de la 25.2 de la Constitució i que tenen
els condicionants de tercer grau o de segon grau amb mesures de semi
llibertat.
Reiterem
que el règim de semi llibertat que se'ls ha concedit permet atendre
a la protecció d'aquests espais i de la població que es troba
reclosa i perquè en dita mesura es puguin evitar contagis massius en
una població ja de per sí vulnerable.
