The ECJ questions equally the Supreme Court and the Central Electoral Board which, incidentally, is the one that sent an "incomplete" list of elected and proclaimed MEPs to the European Parliament... That list was evidently neither the authentic nor the official one.

On May 24 the European Parliament sent a letter to the President of the Central Electoral Board indicating what he had to send it after the elections ... it would be interesting to know why Antonio Tajani accepted an “incomplete” list that was not what he had asked for on May 24.

It would be interesting to know who ordered Drexler, a European Parliament "jurist", to issue a pseudo-legal report that endorsed the subsequent thesis of the Central Electoral Board and that has been refuted by the Advocate General and the ECJ in the same terms as we did in our lawsuit.

It will be interesting, in the light of the Central Electoral Board's decisions, to see what the Third Chamber of the Supreme Court now says in response to our lawsuit against the resolutions of the Board...

It will be of great interest to see how Llarena resolves the EAW issue, bearing in mind that last June we told him that he had to withdraw the arrest warrants and that he could not issue any EAW. (https://twitter.com/boye_g/status/1208490261002825728?s=19)
It will also be very interesting to see how they explain the subject of the oath required by article 224 of the LOREG (electoral law) and that, obviously - and as we said months ago - is contrary to Union Law.

Bringing together the conclusions of the Advocate General and the decisions of the ECJ, the state deputies and senators also had immunity when this was violated by the Supreme Court, the Congress and the Senate... The law always gives leeway for interpretation but in this case the Law was rewritten with a clear political purpose that is alien to, and incompatible with, the jurisdictional function and the impartiality that some attribute to the Central Electoral Board. El TJUE cuestiona, a partes iguales, al Supremo y a la Junta Electoral Central que, por cierto, es la que remitió al Parlamento Europeo una lista “incompleta” de eurodiputados electos y proclamados... evidentemente esa lista no era la auténtica ni la oficial.

El Parlamento Europeo, el 24 de mayo, remitió una carta al Presidente de la JEC indicándole lo que tenían que remitirles después de las elecciones... sería interesante saber por qué @Antonio_Tajani acepto una lista “incompleta” que no era lo que él había pedido el 24 de mayo.

Sería interesante saber quién ordenó Drexler, “jurista” del Parlamento Europeo, emitir un pseudo informe jurídico que avalase la posteriores tesis de la JEC y que han sido refutadas por el Abogado General y por el TJUE en los mismos términos en que lo hicimos en nuestra demanda.

Será interesante, a la luz de las resoluciones del TJUE, ver qué dice ahora la Sala Tercera del Supremo ante nuestras demandas en contra de las resoluciones de la JEC...

Resultará de gran interés ver cómo resuelve Llarena el tema de la OEDE teniendo presente que en junio pasado le dijimos que tenía que levantar las órdenes de detención y que no podía cursar ninguna OEDE. (https://twitter.com/boye_g/status/1208490261002825728?s=19 )
También resultará muy interesante ver cómo explican el tema del juramento requerido por el 224 de la LOREG y que, evidentemente y cómo decimos hace meses, es contrario al derecho de la Unión.

Poniendo en relación las conclusiones del Abogado General con las resoluciones del TJUE los diputados y senadores estatales contaban igualmente con inmunidad cuando les fue vulnerada por el Supremo, el Congreso y el Senado... veremos las consecuencias legales en el TEDH.

El derecho siempre da margen a las interpretaciones pero en este caso se reescribió la Ley con una clara finalidad política que es ajena e incompatible con la función jurisdiccional y con la imparcialidad que algunos le atribuyen a la JEC.
