The prestigious Italian lawyer Luigi Ferrajoli made the following statements* about the conviction of twelve Catalan political and social leaders by Spain's Supreme Court in October. An English translation follows.

Minuto 29.30: Siamo in presenza non solo di un processo orrendo che lede tutti principi e le garanzie penali e pro cessuali, ma anche di un grave colpo alla democrazia spagnola.
Minuto 03.51: Ci troviamo in presenza di una risposta insensata e irresponsabile- benzina sul fuoco-. Con il processo, e ancor prima con I'intervento della polizia, C'è stata la volontà di drammatizzare il conflitto identitario, gettando ulteriore benzina sul fuoco.

[...] Ci troviamo di fronte all'uso come reato di una figura i cui confini con la manifestazione del dissenso sono assolutamente indeterminati [...]

Minuto 29.25: In tutta questa vicenda si stanno manifestando queste intolleranze. La maggior colpa è di quello spagnolo che ha prodotto, o comunque la volisce, la radicalizzazione. L'unica cosa che dobbiamo temere è che cominci la violenza, perché queste cose possono succedere. C'è un'irresponsabilità politica in questa sentenza e del governo che non ha fatto nulla.
Minuto 26.07: Se ci fosse un consenso politico questo sarebbe il classico reato da amnistiare. Occorrerebbe che il governo in un momento di saggezza, proprio perché ciò che si tratta di realizzare è la mediazione politica del conflicto [...] affermasse che non c'è ragione di contrapporsi.
Minuto 27.40: La ragione vorrebbe -vista I'abdicazione della politica che contrassegnerà tutta questa vicenda- che a guesto punto si aprisse un dibattito, una riflessione critica su questa sentenza che rappresenta un grave colpo alla credibilità della democrazia spagnola [...]
Minuto 27.47: Sotto questo aspetto a me pare che sia necessario avviare dei dibattiti in Spagna e comunque I'opinione pubblica europea non può rimanere in silenzio [...] perché è in gioco il futuro dei concetto di democrazia a livello europeo e occidentale.

Minute 29.30: We are in the presence not only of a horrendous trial that violates all penal and procedural principles and guarantees, but is also a serious blow to Spanish democracy.

[...] It is a crime of "suspicion" that incriminates free association. [...] We are faced with the use as a crime of a figure the boundaries of which with the manifestation of dissent are absolutely undetermined [...]
Minute 16.30: It is true that with this crime they ended up pursuing political rights, or the elementary rights of a democracy. [...] Attacking the right of assembly and the right to association means attacking the elementary foundations of political rights.
Minute 29.25: In this whole affair such intolerance is being displayed. The main fault is the Spanish person that has produced raficalization, or at least wants it. The only thing we need to fear is that violence begins, because these things can happen. There is a political irresponsibility in this sentence and in the government, that has done nothing.
Minute 26.07: If there was a political consensus this would be the classic crime to be amnestied. It would require that the government in a moment of wisdom, precisely because what needs to be accomplished is the political mediation of the conflict [...] it is affirmed that there is no reason to oppose this.
Minute 27.40: Given the abdication of politics that will mark this whole affair - reason would say that a debate should open at this point, a critical reflection on this sentence that represents a serious blow to the credibility of Spanish democracy [...]
Minute 27.47: In this respect it seems to me that it is necessary to start up debates in Spain, and in any case European public opinion cannot remain silent ... because the future of the concept of democracy at the European and Western levels is in the balance.
