Article by Reyes Rincón in El País on President Puigdemont

I was amazed to read that the Spanish Supreme court is making utterly political considerations regarding president Puigdemont's EAW and the recent Schleswig-Holstein high court decision. I only hope these are mere speculations by the journalist.

Germany's decision opens a debate in the Supreme Court on the options that remain so as not to leave the former president of Catalonia unpunished

Supreme Court Judge Pablo LIarena is torn between two options regarding the judicial future of former President Carles Puigdemont. One of them is to renounce the delivery of the independence leader if it is confirmed that there is no possibility of Germany agreeing to turn him in for rebellion. That option, defended openly by some sectors of the court, is not, however, the only one on the table. A possible action before the Court of Justice of the European Union is also being considered, to claim that German justice that has not correctly applied the European arrest warrant. There is a third option: to accept the delivery of Puigdemont in the terms agreed by the German court, that is, only for the crime of misuse of public funds. But this is the least likely option and consulted sources discard it on account of the risks that it would entail, including the risk of the independence leader obtaining freedom in Spain and even recovering the presidency of the Generalitat.

The Spanish supreme court does not yet have official knowledge of the German resolution, but it feared for months the decision taken this Thursday, so it has been studying the pros and cons of the ways that would be open to it for preventing the crimes attributed to Caries Puigdemont from going unpunished, on confirmation of the refusal of the German courts to deliver the former president of the Generalitat for rebellion but to do so for misuse of public funds. Judge Pablo LIarena must decide whether to accept the delivery only for this crime (which would prevent him from being tried in Spain on any other charge) or to reject it and let him stay in Germany for the time being.

La decisión de Alemania abre un debate en el alto tribunal sobre las opciones que quedan para no dejar impune al expresidente catalan

El juez del Tribunal Supremo Pablo LIarena se debate entre dos opciones ante el futuro judicial del expresidente catalán Carles Puigdemont. Una de ellas, renunciar ya a la entrega del líder independentista si se confirma que no hay ninguna posibilidad de que Alemania acepte entregarle por rebelión. Esa opción, defendida abiertamente por algunos sectores del tribunal, no es, sin embargo, la única que està encima de la mesa. También se considera una posible acción ante el Tribunal de Justicia de la UE para plantear que la justicia alemana que no ha aplicado correctamente la orden europea de detención. Hay una tercera posibilidad: aceptar la entrega de Puigdemont en los términos acordados por el tribunal alemàn, es decir, solo por el delito de malversación. Pero esta alternativa es la menos probable y fuentes consultadas la descartan por los riesgos que conllevaría, incluido que el líder independentista consiguiese la libertad en España y hasta pudiera recuperar la presidencia de la Generalitat.

El alto tribunal español no tiene todavía conocimiento oficial de la resolución de Alemania, pero temía desde hace meses la decisión que ha tomado este jueves, por lo que ha estado estudiando los pros y los contras de los caminos que le quedarían para evitar que los delitos que atribuye a Caries Puigdemont queden impunes, si se confirma la negativa de la justicia alemana a entregar al expresidente de la Generalitat por rebelión pero sí hacerlo por malversación. El juez Pablo LIarena deberá decidir si acepta la entrega solo por este delito (lo que impediría juzgarlo en España por ningún otro) o la rechaza y deja que se quede de momento en Alemania.
