Communiqué by the Catalan Bar Council in relation to the trial of the 17 August 2017 terrorist attacks
The Catalan Bar Council, meeting today, 13 November 2020, at the joiny meeting of the Governing Boards of the 14 councils of the bar that composes it, has adopted the following Agreement:
We express our deepest rejection and indignation by the way presiding Judge Félix Alfonso Guevara Marcos is behaving before the Criminal Chamber of the National High Court in the trial for the attacks committed on 17 August 2017 in Barcelona and Cambrils. This treatment is a serious limitation to the defence, the mainstay of any democratic state and the rule of law, in which, above all, the exercise of law must guarantee the full exercise of rights and freedoms. It is unacceptable that in Court such behaviour occurs by those who have to administer justice, whom we as lawyers always deeply respect.
We reserve the right to file a complaint with the General Council of the Judiciary, should these facts could constitute the offence dealt with in Article 418.5 of the LOPJ, of serious misconduct with respect to citizens, institutions, secretaries, forensic doctors, and other staff in the service of the administration of justice, members of the Public Prosecutor's Office, counsel and barristers, social graduates and Judicial Police officers.
