The trial continues unstoppable in its daily routine. It has already lasted six weeks. Time passes quickly and the witnesses take longer than the judges would like when they come to testify before the Court. Everything suggests that the first timelines Manuel Marchena had caressed to have everything ready for a sentence in the first week of May have blown aay in the wind. Nobody, at this moment, dares to rebuild forecasts, but between session and session, the conversations between lawyers, magistrates and officials of the Supreme Court allow us to suspect that it is likely that until early June things will not be ready for the verdict.

We, the transitional tenants of Soto del Real* and the tenants of Alcalá-Meco*, continue with resignation the daily transfers from prison to the National Court and then from the National Court to the Supreme Court, hoping that soon the Court will review a pre-trial detention which is as unfair as it is exhausting right now.

This week - and also in coming weeks - the Civil Guard has been the protagonist, with which it seems that there has been a new addition to the narrative of the accusation. As I said, most of the testimonies have been civil guards and, in a disciplined and harmonic way, they have carried out well the job that seems to have been commissioned by someone, as far as creating the feeling that everyone entered with the lesson perfectly learned and perfectly ready to be recited. Well trained and disciplined, they have brought a new concept in through the back door: that of hatred.

It may seem like a matter of no import, a game that is more typical of scenes out of Berlanga, or even - and better still, listening to the tale of some of them - of the most histrionic Almodóvar, which could well be a new production by the filmmaker under the title La Benemérita [The Civil Guard] on the verge of a nervous attack. But what happens in the courtroom of the Supreme Court is no movie and far less of comedy. And nothing, absolutely nothing of what they said and what the civil guards will say in the coming days, strays from what seems to be a previously agreed pattern. Otherwise, it is difficult to imagine how each and every one uses the same words, and even the same expressions.

Once the prosecution exercised by the Spanish state has seen that they will not be able to prove in any way the existence of violent events, someone seems to have decided in the last minute to turn around and hatred at the centre of the debate. A concept that until now had not been present in almost any journalistic chronicle to speak of October 1, in no way and in any text of the Prosecutor General's Office or the investigating judge. In three days it has been the word most used by the witnesses, while violence has already been described by various agents and in answer to defence questions only as "a slight possibility", that is, that there was not any.

We have heard an agent say that in 25 years of active service in the fight against organized crime (drug traffickers, arms dealers...), he had never seen so much vented rage as in protests on September 20th in front of Foreign Affairs in the Via Laietana. We have seen another agent explain that for the first time in his professional career he had seen the reflection of hatred in the faces and gestures of those who protested on September 19th in front of the Unipost headquarters in Terrassa.

Others, taking another step in the web of the narrative though up and told in order to condemn us, have not had any problem of conscience - despite declaring under oath - to say that what they had experienced in the protests of September 19th and 20th Catalonia seemed quite similar to  the Basque conflict, adding the concept of extreme hatred as a category. And thus, one after another, without any error in the interpretation. Just as if a hidden hand had written a script to guide the statements.

And all this happened without any of the civil guards who testified having been hit even once, or having seen any colleague of the corps injured, or having witnessed any aggression or violent act by the protesters. The only specification of all the hatred experienced was, literally, "the techniques of sitting on the ground and linking arms". 

We have seen and will see dozens of agents testifying with words of intent but devoid of truth. Bad intent, it needs to be made clear, that does not stand up to the slightest contrast with the hundreds of videos that we defendants have presented and that the defences want to be seen at this moment in the trial to make it clear that nothing of what the policemen say about the faces of hatred and the violence exerted by the protesters conforms to the truth. The Court, however, has decided that it will not allow the images of the videos to be confronted at this moment with the words of the policemen.

[Judge] Marchena says the videos will be viewed later, when the witnesses will no longer be around. Everyone knows, however, that it is not the same to deny or simply contrast words just after they have just said or a few weeks later. The rules of the game, however, are set by the Court. In this regard, we prisoners are on the receiving end and it will almost cetainly be the European Court of Human Rights that will have the last word as regards what in my opinion is a clear violation of the right of defence. Having said that, we are still hopeful that in the end justice will prevail and the acquittal will arrive.

El judici segueix imparable en la seva rutina diària. Ja portem sis setmanes. El temps passa ràpid i els testimonis circulen més lents del que els jutges voldrien quan venen a declarar davant el Tribunal. Tot apunta que els primers calendaris que Manuel Marchena havia acariciat per deixar-ho tot vist per a sentència la primera setmana de maig han saltat pels aires. Ningú, a hores d’ara, s’atreveix a refer previsions, però entre sessió i sessió les converses entre advocats, magistrats i oficials del Suprem deixen entreveure que és versemblant assumir que fins ben iniciat juny res estarà a punt per sentenciar.
Nosaltres, els inquilins transitoris de Soto del Real i les inquilines d’Alcalá-Meco, seguim amb resignació els ritmes diaris de trasllats des de la presó fins a l’Audiència Nacional i de l’Audiència al Suprem amb l’esperança que aviat el Tribunal revisarà una presó preventiva tan injusta com, en aquests moments, esgotadora.
Aquesta setmana -i també les que vindran- la Guàrdia Civil ha estat la protagonista, amb qui sembla que s’ha produït un nou afegitó en el relat de l’acusació. Com deia, la major part dels testimonis han estat guàrdies civils i, disciplinadament i harmònicament, han fet bé la feina que sembla que algú els havia encarregat, fins al punt de crear la sensació que tots venien perfectament amb la lliçó apresa i disposats a recitar-la. Ben ensinistrats i disciplinats han fet entrar per la porta del darrere un nou concepte: el de l’odi.
Pot semblar un tema sense importància, un joc més propi d’unes escenes de Berlanga o fins i tot -i millor encara escoltant el relat d’alguns d’ells- de l’Almodóvar més histriònic, en el que bé podria ser una nova entrega del cineasta sota el títol de La Benemérita al borde de un ataque de nervios. Però el que succeeix a la sala de vistes del Tribunal Suprem no és cap pel·lícula i menys d’humor. I res, absolutament res del que van dir i del que diran els guàrdies civils els propers dies s’escapa del que sembla una pauta prèviament pactada. Altrament, és difícil imaginar com tots i cadascun d’ells utilitzen les mateixes paraules, i fins i tot les mateixes expressions.
Un cop l’acusació que exerceix l’estat espanyol ha vist que no podran provar de cap de les maneres l’existència de fets violents, algú sembla haver decidit a darrera hora fer un gir més i posar l’odi al centre del debat. Un concepte que fins ara no havia estat present en quasi cap crònica periodística per parlar de l’1 d’Octubre, en cap atestat i en cap escrit de la Fiscalia ni del jutge instructor. En tres dies ha estat la paraula més utilitzada pels testimonis, mentre que la violència ja ha passat a ser definida per diversos agents i a preguntes de la defensa només com “ una posibilidad extrema ”, és a dir, que no n’hi va haver.
Hem sentit un agent afirmar que després de 25 anys de servei actiu en la lluita contra el crim organitzat (narcos, traficants d’armes...) mai havia vist tanta ràbia descontrolada com en les protestes del 20 de setembre davant d’Exteriors a la Via Laietana. Hem vist un altre agent explicar que per primera vegada en el seu exercici professional havia vist el reflex de l’odi en les cares i els gestos dels qui protestaven el 19 de setembre davant la seu d’Unipost, a Terrassa.
D’altres, fent un pas més en la teranyina del relat pensat i narrat per condemnar-nos, no han tingut cap problema de consciència -malgrat declarar sota jurament- per afirmar que el que havien viscut en les protestes del 19 i el 20 de setembre a Catalunya s’assemblava bastant al conflicte basc, afegint el concepte de l’odi extrem com a categoria. I així un darrere l’altre, sense cap error en la interpretació. Talment com si algú -ocult- hagués escrit un guió per orientar les declaracions.
I tot això sense que cap dels guàrdies civils que van testificar hagués patit cap cop, hagués presenciat cap company del cos ferit, ni hagués pogut presenciar cap agressió ni acte violent per part dels manifestants. L’única concreció de tot l’odi viscut eren, i cito literal, “les tècniques de seure a terra i agafar-se del braç”.
Hem vist i veurem desenes d’agents testificant amb paraules plenes d’intenció però buides de veritat. Mala intenció, cal deixar-ho clar, i que no suporta el mínim contrast amb els centenars de vídeos que els acusats hem aportat i que les defenses volen que es visionin en aquest moment del judici perquè quedi clar que res del que diuen els agents sobre les cares d’odi i la violència exercida pels manifestants s’ajusta a la veritat. El Tribunal, però, ha decidit que no permetrà confrontar en aquest moment processal les imatges dels vídeos amb les paraules dels agents.
Marchena diu que els vídeos es revisaran més endavant, quan els testimonis ja no hi siguin. Tothom sap, però, que no és el mateix desmentir o simplement contrastar unes paraules quan s’acaben de dir que al cap d’unes quantes setmanes. Les regles de joc, però, les fixa el Tribunal. En aquest aspecte els presos tenim les de perdre i amb tota seguretat serà el Tribunal Europeu de Drets Humans qui tindrà la darrera paraula davant el que en la meva opinió és una clara vulneració del dret de defensa. Dit això, seguim esperançats que al final es farà justícia i arribarà l’absolució.

Supreme Court judge Prego's 2008 warning: rebellion and sedition would be inapplicable

In 2008, an eminent Spanish criminal law specialist and former Supreme Court judge argued that the Criminal Code, as amended in 1995, does not allow a peaceful, democatic declaration of independence to be considered to be treason, sedition or rebellion. Both the latter require violent o tumultuous uprisings which, as we have seen, simply have not happened in Catalonia.

Injured Policemen (1 October 2017)

The number of Spanish policemen reported as having been injured during their attempts to prevent the referendum of October 1 2017 increased from 33, in the evening of the same day (though a Ministry tweet said there were "countless!" other injured officers) to 431 and waned months later to 111 (March 2018), to 93 (February 2019). Five policemen had to take sick leave according to early claims, but by March 2019 even these were denied by Sr. Millo before the Supreme Court, while data were still being hidden.
