Public Prosecutor Pedro Rubira's clanger (5 FEB 2019)

On the first day of the preliminary hearings of the trial of Major Trapero and others in the National Court (Madrid), on charges of rebellion (sic) that could have him locked up for up to 11 years if found guilty, a statement by the public prosecutor has inflamed public opinion in Catalonia, and in Spain's judicial system as a whole.

Pedro Rubira, public prosecutor to the National Court in Madrid, is epoted to have said: "Do you really think that it is not the jurisdiction of the National Court? Can there be impartiality and serenity if the rebellion and sedition [cases] are sent to Catalonia? Do you think that this serenity, this impartiality, can exist?"

And I ask: "Can there be 'impartiality and serenity' if "the rebellion and sedition are sent to"... Germany? Belgium? Scotland?"

As I hope he will say most certainly yes, then I shall ask him: how come no-one other than the Public prosecuion, the State Legal Service, and the ultanationalist Spanish party Vox can find the slightest hint of rebellion and sedition in Catalonia? I look forward to his answer.

What's more: does the jurisdiction (and therefore a recognized right in all international instruments) depend on subjective valuations?

Are not appeals to higher courts, in part, to rectify the lack of 'impartiality and serenity' of first instance courts, once found with facts?

Outside Spain, nowhere in the civilized world, would the nine Catalan politicians and social leaders be imprisoned, far less put in pre-trial detention, for... the problem IS POLITICAL, NOT CRIMINAL!

Finally, I trust that all the professional associations of judges and prosecutors, and the General Council of the Judicial Branch, will make you fall over all the weight of the law. That of its law... and that of any lawful State.

Governing board decision on the statements made by the prosecutor Mr. Rubira in the National Court

Barcelona, ​​February 5, 2019.-
The Governing committee of the High Court of Justice has this afternoon adopted the following decision, with the absence of the president, as recorded in the corresponding minutes:

The Governing committee of the High Court of Justice, constituted in the Permanent Commission, without the attendance of its president, in the face of the allegations made by the prosecutor Sr. Rubira during this morning's hearing before the National Court, in which he queried, in a textual and unambiguous manner, the impartiality of the judges who perform their role in Catalonia to assume jurisdiction with regard to certain causes that are being followed for alleged crimes of rebellion and sedition, wishes to undeline the following considerations:

The statements made by the prosecutor Mr. Rubira amount to a very serious and unjustified attack on the Judiciary as a whole and, as a result, on the constitutional system itself.

For a member of the Public Ministry to doubt the impartiality of the judges who work in Catalonia, in the exercise of criminal action, is a very serious irresponsibility by a person who has, precisely, by constitutional and statutory mandate, the duty to protect the independent and impartial exercise of jurisdiction.

It is quite unusual, and very worrying, for the use of such a presupposition, which makes not the slightest normative and factual sense, in support of a procedural claim. The Public Posecution, given the role it plays in the procedure and the high function entrusted to it by the Constitution, cannot descend to demagogy, banality or offence in order to defend the public interests it represents.

The Governing committee wants to insist to all those who put in doubt in a self-serving and irresponsible way the jurisdictional work that we judges that perform in Catalonia carry out, that we act now and shall always act in compliance with our constitutional duties, among which impartiality occupies a very prominent place. Thousands of daily actions to guarante the rights and freedoms of all, abundantly attest to this.

Pedro Rubira diu, pel que sembla: "Realment pensen vostès que no és competència de l'Audiència Nacional? Hi pot haver imparcialitat i serenitat si s'envia la rebel·lió i la sedició a Catalunya? Vostès pensen que hi pot haver aquesta serenitat, aquesta imparcialitat?"

I jo li demano: "Hi pot haver 'imparcialitat i serenitat' si s'envia la rebel.lió i la sedició a Alemanya? A Bèlgica? A Escòcia?" Com espero que dirà que sí, aleshores li demano: com és que ningú més que a la Fiscalia general, a l'Advocacia de l'Estat, i a Vox, hi veuen el més petit indici de rebel·lió i sedició a Catalunya? Que m'ho contesti.

És més: la jurisdicció (i per tant, un dret reconegut a tots els instruments internacionals) depèn de valoracions subjectives?

Els recursos a tribunals superiors no són, en part, per rectificar la falta de 'imparcialitat i serenitat' de tribunals de primera instància, un cop constatada amb fets?

Fora d'Espanya, a cap lloc del món civilitzat els nou polítics i dirigents socials #catalans estarien encausats ni molt menys empresonats preventivament perquè... el problema ÉS POLITIC, NO PENAL!

Finalment, confio que totes les associacions professionals de jutges i fiscals, i el Consell General del Poder Judicial, li faran caure al damunt tot el pes de la llei. El de la seva llei... i la de qualsevol Estat de dret.

Acuerdo Sala de Gobierno sobre las manifestacions realizadas por el fiscal Sr. Rubira en la Audiència Nacional


Barcelona, 5 de febrero de 2019.-

La Sala de Gobierno del Tribunal Superior de Justicia ha aprobado esta tarde, con ausencia del presidente, tal como recoge el acta correspondiente, el siguiente acuerdo:

La Sala de Gobierno del Tribunal Superior de Justicia, constituida en Comisión Permanente, sin la asistencia de su presidente, ante las alegaciones vertidas por el fiscal Sr. Rubira en la vista desarrollada esta mañana ante la Audiencia Nacional, en las que cuestionaba, textualmente y sin ambages, la imparcialidad de los jueces y juezas que desempeñan su función en Catalunya para asumir la competencia respecto a determinades causas que se siguen por presuntos delitos de rebelión y sedición, quiere poner de relieve las siguientes consideraciones:

Las afirmaciones realizadas por el fiscal Sr. Rubira suponen un ataque muy grave y sin justificación alguna al Poder Judicial en su conjunto y, con ello, al propio sistema constitucional.

Cuestionar por un miembro del Ministerio Público, en el ejercicio de la acción penal, la imparcialidad de los jueces y juezas que ejercen en Catalunya, constituye una gravísima irresponsabilidad de quien tiene, precisamente, por mandato constitucional y estatuario el deber de protegir el ejercicio independiente e imparcial de la jurisdicción.

Resulta del todo insólito, y muy preocupante, que pueda utilizarse un juicio de intenciones carente del minimo sentido normativo y fàctico en apoyo de una pretensión procesal. El Ministerio Fiscal por el rol que ocupa en el proceso y por la alta función que la Constitución le encomienda, no puede ceder a la demagogia, a la banalidad o a la ofensa para la defensa de los intereses públicos que representa.

La Sala de Gobierno quiere insistir frente a todos los que cuestionan de manera interesada e irresponsable la labor jurisdiccional que desarrollamos los jueces y juezas que ejercemos en Catalunya que ahora y siempre actuaremos en cumplimiento de nuestros deberes constitucionales, entre los cuales la imparcialidad ocupa un lugar muy destacado. Miles de actuaciones diarias en garantía de los derechos y libertades de todos, lo acreditan sobradamente.
